The man accused of killing an Ole Miss student last month will not seek to be released on bond, but instead will have a psychological evaluation, his defense attorney said in court early Thursday.

The Oxford Eagle reports that Brandon Theesfeld’s defense attorneys withdrew a request for a bond hearing due to some “new information” and said Theesfeld would have a psychological evaluation at the Mississippi State Hospital.

Theesfeld will remain incarcerated without bond.

Theesfeld, 22, and a former student at the University of Mississippi, is charged with the murder of fellow student Alexandria “Ally” Kostial, 22, of Kirkwood, Missouri. Her body was found July 20 near a lake in a rural part of Lafayette County.

Theesfeld was arrested a couple of days after her body was found and charged with murder. Thursday’s court appearance was initially aimed at his attempt to obtain a bond so he could be released from jail.

District attorney Ben Creekmore told the court Thursday the prosecution plans to present the case to a Lafayette County Grand Jury next week.

Tony Farese, co-counsel for Theesfeld said Theesfeld will enter a plea of not guilty.
